Federal FLSA rule: overtime at 1.5× your regular rate for hours over 40/week. Some states (e.g. California) add daily overtime rules — this calculator uses the federal standard.

How overtime pay works

Under the federal Fair Labor Standards Act (FLSA), non-exempt employees must receive at least 1.5× their regular hourly rate for hours worked beyond 40 in a workweek. Overtime is calculated weekly — working 10-hour days does not trigger federal overtime unless the week exceeds 40 hours.

State overtime differences

Some states go further: California requires 1.5× after 8 hours in a day and 2× after 12 hours. Salaried “exempt” employees (executive, administrative, professional duties above the salary threshold) are generally not entitled to overtime.

FAQs

How is overtime pay calculated?

Multiply your regular hourly rate by 1.5, then by overtime hours. Example: $25/hr × 1.5 = $37.50/hr; 10 OT hours = $375/week extra.

Who qualifies for overtime pay?

Non-exempt employees under the FLSA. Exempt salaried workers in executive, administrative, or professional roles above the salary threshold generally do not.

Is overtime taxed differently?

No. Overtime pay is taxed as ordinary income — same federal, state, and FICA rules as regular wages. A bigger paycheck can push you into a higher withholding bracket temporarily.

Does California have different overtime rules?

Yes — California requires daily overtime: 1.5× after 8 hours/day and 2× after 12 hours/day, plus 1.5× after 40/week. This calculator uses the federal weekly standard.
